SUBJECT: The U.S. Army Corps of Engineers, Omaha District, (Corps) is evaluating a permit

project described herein is not being proposed by the Corps, but by the applicant; the

AUTHORITY: This application is being evaluated under Section 404 of the Clean Water Act for

LOCATION: The project is located on state highway MT 117 from Reference Post (RP) 11.21 to
RP 13.0, near Nashua, MT, in Valley County. The project is located within Section 1 of Township
27N, Range 41E; Section 36 of Township 28N, Range 41E; and Section 31 of Township 28N,
Range 42E, Principal Meridian of Montana, and is centered approximately at Latitude 48.1339
and Longitude -106.3718.
PROJECT PURPOSE/DESCRIPTION: The purpose of the proposed project is to improve safety
and mobility for the residents of Nashua, MT and the traveling public by providing a secondary
access to U.S. Highway 2 (US 2) via a grade-separated crossing of the BNSF Railroad. Safety
improvements include improving roadway geometrics, roadway surface, striping and shoulder
widths, and reducing through traffic at the at-grade railroad crossing.
The proposed project would reconstruct and realign the roadway from the Milk River Bridge to the
intersection with US Highway 2, construct a grade-separated crossing over the BNSF Railway,

irrigation culvert under MT 117 with a 36" x 178' culvert. A pavement preservation treatment would

1 The wetland delineation boundary provided for Wetland 2 included only the eastern edge of the wetland (oxbow area). The end
points of the delineation boundary were connected and the resulting polygon totals 9.3 acres. The total area of wetland 2 including
the area outside of the boundary shown on the plans is estimated to be up to 30 acres.
ALTERNATIVES:
No Action Alternative. The No-Build Alternative is a non-construction alternative that would
maintain the existing conditions along the entire length of the corridor and only minor upgrades
through routine maintenance would occur to MT 117. The No-Build Alternative would not address
the purpose or need for the Proposed Action for the following reasons:

Safety concerns: the existing horizontal alignments, roadway widths, side slopes and
pavement conditions would remain along MT 117, contributing to safety concerns. The current
at-grade railroad crossing would continue to be an area of concern as train and vehicle
volumes increase in the future.
Emergency vehicle response time: emergency vehicles would continue to utilize the at-grade
crossing in Nashua to access residences to the south of the railroad. Crossing closures would
continue to affect emergency vehicle response times.
Roadway deficiencies: roadway widths, side slopes, and pavement conditions would continue
to be insufficient compared to current MDT design criteria.
Overall, the objective of improving conditions on MT 117 and providing a grade-separated
connection to US 2 for the purpose of improving safety and mobility would not occur under the NoBuild Alternative. As such, the No-Build Alternative is not practicable as it would neither meet the
purpose and need of the project nor the transportation needs of the public.

Alignment Alternatives. Four alignment alternatives were considered and are summarized
below. The preliminary wetland impacts that supported the alternatives analysis and selection of
the preferred alignment were based upon preliminary engineering and roadway modeling and
limited geotechnical information at the time of analysis. The table below includes the preliminary
findings for the four build alternatives examined. Through final design and alignment modifications
to minimize private property impacts, the final estimated wetland impacts for the preferred
alignment, West Alignment Option 1, have increased. The preliminary wetland impacts for the
other alternatives would have increased similarly in proportion and therefore the preliminary
wetland impacts presented in Table 1 still provide a valid comparison of scope of impact between
alternatives.
The primary distinguishing difference between the various build alternatives relates to the location
of new alignment of MT 117 and overpass under consideration. The east options explore a new
alignment that is located to the east of a homestead property (Ersland property) situated at the
northwest corner of the existing MT 117/County Road intersection and the west options provide
for two alternatives on the west side of the Ersland property. Refer to Figure 1 for a depiction of
the alternative alignments.

MITIGATION: Avoidance, Minimization and Compensatory Mitigation: The project design team
has made all practicable efforts to avoid and minimize impacts to wetlands and streams. The
wetlands were avoided to the greatest extent practicable. Wetlands occur in the immediate vicinity
of the existing roadway throughout the project limits. Avoidance of all impacts was not possible due
to the need to widen the roadway, flatten slopes, adjust the vertical grade to correct vertical sags,
and replace the culverts and structures occurring along the project corridor. The following
measures were incorporated in design to avoid and minimize wetland impacts to the greatest extent
practicable while still achieving the improved roadway conditions and safety for the travelling public:

Wetland 1 (a small wetland located at approximately station 621+00 RT) was avoided
completely by reducing the project footprint and fill slopes at this location. The realignment of

MT 117 begins at this location and the western shift of the alignment results in avoiding
Wetland 1.
The realignment of MT 117 was shifted as far east as possible to reduce the footprint and
minimize impacts to the oxbow wetland (Wetland 2). Complete avoidance of Wetland 2 was
not possible due to the private residence located at the junction of the existing MT 117 and
County Road.
The new intersection of Nashua Blvd. and MT 117 was shifted as far south as possible in
order to reduce the footprint and impact to Wetland 5 and to utilize the existing footprint of
Nashua Blvd. to greatest extent practicable while still maintaining design standards.
Side slopes throughout the project were optimized to the extent practicable as to reduce the
overall footprint.
Reinforced soil slopes are utilized at the bridge abutments, as opposed to flatter slope paving
options, reducing overall wetland impacts.
The project will incorporate standard water quality BMP's during construction as specified in
the standard specifications and special provisions of the contract documents, as well as
following any special considerations as specified by the Section 404 permit.
To compensate for unavoidable impacts, the applicant proposes the following measures:
Wetland Mitigation: The project as proposed would result in permanent impacts to
approximately 7.92 acres of wetlands from the placement of fill, culverts, and irrigation structures.
Unavoidable wetland impacts will be mitigated at the MDT Rock Creek Ranch wetland mitigation
site located at Section 1, Township 27N, Range 43E, within Valley County. This mitigation
reserve is located in the same watershed as the wetland losses; has been established in advance
of the project impacts; and the wetlands at the Rock Creek Ranch wetland mitigation site have a
higher wetland functional classification (category II) than the wetlands that will be unavoidably
impacted (category III) by this project; therefore a replacement ratio of 1:1 will be used.
Stream Mitigation: The project as proposed will not impact any river or stream banks. Impacts
will occur to approximately 178 linear feet of jurisdictional irrigation ditch. Compensatory stream
mitigation is not anticipated to be required.
OTHER GOVERNMENTAL AUTHORIZATIONS: The Montana Department of Environmental
Quality, 1520 East 6th Avenue, PO Box 200901, Helena, Montana 59620-0901 will review the
proposed project with the intent to certify in accordance with the provisions of Section 401 of the
Clean Water Act. The certification, if issued, will express the State's opinion that the operations
undertaken by the applicant will not result in a violation of applicable water quality standards. The
Montana Department of Environmental Quality hereby incorporates this public notice as its own
public notice and procedures by reference thereto.
CULTURAL RESOURCES: Historic properties eligible for or included on the National Register of
Historic Places (NRHP) are protected under Section 106 of the Historic Preservation Act and
Section 4(f) of the 1966 Department of Transportation Act. Tribal cultural resources are protected
through the Native American Graves Protection and Repatriation Act and the Archaeological
Resources Protection Act.
The Federal Highway Administration (FHWA) is the lead Federal Agency for the proposed project
and is responsible for ensuring compliance with these regulations. A cultural resource report was
completed and found several historic properties in the project area that are listed or eligible for
listing on the NRHP. One site was later deemed ineligible for listing. A determination of No
Adverse Effect to Historic Properties was made for the proposed project. The Montana Historic

Preservation Office (SHPO) concurred with the effects determination on October 22, 2013. We will
evaluate input by the State Historic Preservation Office, Tribes and the public in response to this
public notice and we may conduct or require a survey of the permit area to check for unknown
historic or prehistoric properties, if warranted.
THREATENED / ENDANGERED SPECIES: In compliance with the Endangered Species Act, a
preliminary determination has been made by FHWA/MDT that the described work will not affect
species designated as threatened or endangered, or adversely affect critical habitat. Federally
listed species reasonably expected to occur within Valley County include the endangered Pallid
Sturgeon (Scaphirhynchus albus), Interior Least Tern (Sterna antillarum athalassos), Piping
Plover (Charadrius melodus), Red Knot (Calidris canutus rufa), and Whooping Crane (Grus
Americana). Valley County contains critical habitat for Piping Plover, but this does not overlap the
project action area. In order to complete our evaluation of this activity, comments are solicited
from the U.S. Fish and Wildlife Service and other interested agencies and individuals.
EVALUATION FACTORS: The decision whether to issue a permit will be based on an evaluation
of the probable impacts, including cumulative impacts, of the proposed activity on the public
interest. That decision will reflect the national concern for both protection and utilization of
important resources. The benefits which reasonably may be expected to accrue from the
proposed activity must be balanced against its reasonably foreseeable detriments. All factors
which may be relevant to the proposal will be considered, including the cumulative effects thereof;
among those are conservation, economics, aesthetics, general environmental concerns,
wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use,
navigation, shoreline erosion and accretion, recreation, water supply and conservation, water
quality, energy needs, safety, food and fiber production, mineral needs, considerations of property
ownership and, in general, the needs and welfare of the people. In addition, the evaluation of the
impact of work on the public interest will include application of the guidelines promulgated by the
Administrator, Environmental Protection Agency, under authority of Section 404(b) of the Clean
Water Act (40 C.F.R.; Part 230).
COMMENTS: The Corps of Engineers is soliciting comments from the public; Federal, state, and
local agencies and officials; Indian Tribes; and other interested parties in order to consider and
evaluate the impacts of this proposed activity. Any comments received will be considered by the
Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this
proposal. To make this decision, comments are used to assess impacts on endangered species,
historic properties, water quality, general environmental effects, and the other public interest
factors listed above. Comments are used in the preparation of an Environmental Assessment
and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act.
Comments are also used to determine the need for a public hearing and to determine the overall
public interest of the proposed activity. All public notice comments will be considered public
information and will be subject to review by the applicant.
Any person may request, in writing and within the comment period specified in this notice, that a
public hearing be held for the purpose of gathering additional information. Requests for public
hearings must be identified as such and shall state specifically the reasons for holding a public
hearing and what additional information would be obtained. The request must be submitted to the
U.S. Army Corps of Engineers, Post Office Box 2256, Billings, Montana 59103. If it is decided
that additional information is required and that a public hearing should be held, interested parties
will be notified of the date, time and location.
