The applicant is proposing to construct a single family residential development at a site generally located on the south line of Route 673, northwest of Route 614, in Goochland County, Virginia. The project is being evaluated under the State Program General Permit. The Corps has determined that the project will have an adverse effect on-site a log house determined to be eligible for listing on the National Register of Historic Places. The Corps, Virginia Department of Historic Resources, the permittee and other consulting parties are proposing to enter into a Memorandum of Agreement (MOA) under Section 106 of the National Historic Preservation Act.

FEDERAL PUBLIC NOTICE The District Commander has received a joint application for Federal and State permits as described below: APPLICANT Rocketts Ridge, LLC Charles Messer 11123 Cauthorne Road Glen Allen, Virginia 23059 WATERWAY AND LOCATION OF THE PROPOSED WORK: The project site is approximately 162 acres and is located on the south line of Route 673, northwest of Route 614, in Goochland County, Virginia. The site drains into Rocketts Creek, which drains into Big Lickinghole Creek, a tributary to the James River. PROPOSED WORK AND PURPOSE:The project is being evaluated under the State Programmatic General Permit (SPGP). The applicant proposes to construct a single family residential development consisting of 46 lots. The applicant proposes to discharge fill material in 0.23 acre of forested wetlands and 237 linear feet of stream channel for the construction of roads, associated erosion and sediment control measures and one residential lots. This project was previously authorized in 2008 but impacts were not taken and the authorization has expired. PURPOSE OF PUBLIC NOTICE:The Corps’ permit action associated with this project is subject to Section 106 of the National Historic Preservation Act (NHPA). Procedures have been established which must be followed in order for the Corps to comply with the NHPA and other applicable historic preservation laws.The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Native American Tribes; and other interested parties in compliance with Section 106 of the NHPA.This public notice provides an opportunity for members of the public to express their views on the undertaking’s effects on historic properties and resolution of adverse effects. Comments are requested to assist in evaluation of the effects of the project on historic properties and evaluation of alternatives or modifications which could avoid, minimize or mitigate adverse effects on historic properties. Historic Property Identification:The identification of historic properties has been conducted on the proposed development site. A report of the survey was prepared and is titled, “Phase II Architectural Evaluation of the Log House (037-5054) at 3653 Whitehall Rd.” prepared by Dutton and Associates and dated February 22, 2008. The survey and report are a reasonable and good faith effort to identify historic properties.The survey identified an architectural site, 037-5054 a log house constructed approximately in 1839 and determined to be eligible for listing on the National Register of Historic Places. ADVERSE EFFECT DETERMINATION:In consultation with the SHPO, and in consideration of views concerning effects provided by consulting parties, the USACE has applied the criteria of adverse effect to historic properties within the Area of Potential Effect (APE). An adverse effect on the log house has been found for the project. The USACE is consulting further to develop and evaluate alternatives or modifications to the undertaking that could avoid, minimize, or mitigate adverse effects on historic properties.The US Army Corps of Engineers (Norfolk District), Virginia Department of Historic Resources, the permittee and other consulting parties are proposing to enter into a Memorandum of Agreement (MOA) under Section 106 of the National Historic Preservation Act. A MOA was previous executed when the project was original authorized and has expired.
