LETTER OF PERMISSION: Mr. Landon Bode (the Applicant) is requesting to retain some drainage system improvements that were recently installed on his property, within the wetland basin labeled as 1A & 2A on the attached figures, needed to maintain existing drainage through the Applicant’s parcel contributed from upstream neighbors.
PROJECT DESCRIPTION AND PURPOSE: Mr. Landon Bode (the Applicant) is requesting to retain some drainage system improvements that were recently installed on his property, within the wetland basin labeled as 1A & 2A on the attached figures, needed to maintain existing drainage through the Applicant’s parcel contributed from upstream neighbors. The Applicant is also requesting to retain draintile improvements that were installed within the farmed wetland labeled as 2B on the attached figures, to better facilitate crop production in the area. In addition, the Applicant is proposing to remove the majority of drainage system improvements that were recently installed within wetland basin 1A & 2A, as described on the attached Figures 2-4, to ensure that this wetland basin retains historic hydrology and wetland boundaries as shown on the attached Natural Resource Conservation Service (NRCS) Certified Wetland Determination that was completed for parcel (Figure 1). These abovementioned activities have been reviewed and approved by the NRCS and the Nicollet County Wetland Conservation Act Technical Evaluation Panel.

NAME, AREA AND TYPES OF WATERS (INCLUDING WETLANDS) SUBJECT TO LOSS:
The drainage maintenance work that is proposed to be retained within wetland basin 1A and 2A
involved replacing the ditch feature that historically dissected the wetland basin with draintile.
Backfilling this approximately 728 linear foot portion of ditch, and covering the draintile, resulted
in the discharge of fill material within approximately 7,280 square feet of ditch bottom. The
remaining approximately 680 linear foot portion of ditch on the property, that historically
spanned from the outlet of wetland 1A and 2A to just north of Trunk Highway (TH) 14, was also
replaced with draintile and backfilled resulting in the discharge of fill material within an additional
1,360 square feet of ditch bottom. Retention of the draintile within Wetland 2B is expected to

effectively drain the entire wetland basin, adversely impacting approximately 2.1 acres of
seasonally flooded type wetland.
ALTERNATIVES CONSIDERED: The Applicant considered maintaining the existing ditch on his
property, but dismissed this alternative due to long-term maintenance and safety concerns. The
Applicant also considered improving the drainage system within and surrounding Wetlands 1A
and 2A, to improve drainage within this basin and increase farmable land on his property, but
dismissed this alternative because it was not the least environmentally damaging practicable
alternative for the project. The Applicant's preferred alternative would maintain existing
hydrology within the higher quality wetland on the property, Wetlands 1A and 2A, and would
eliminate hydrology within a lower quality farmed wetland on the property, Wetland 2B.
COMPENSATORY MITIGATION: The Applicant has proposed to compensate for the 2.1 acres
of permanent wetland loss associated with this project, at a 1:1 ratio, via purchase of 2.1
wetland bank credits from a Corps approved agricultural specific wetland bank within the same
Bank Service Area (BSA) as the impact site, BSA 9.
