STATE - KY; APPLICANT - The Northern Kentucky University, Stream and Wetland In-Lieu Fee Program; PROJECT PROPOSAL - To provide aquatic habitat enhancement and establishment and upland buffer enhancement.

This notice describes an application submitted for a Department of the Army (DA) Permit, subject to Section 404 of the Clean Water Act. The project is being considered for authorization in accordance with 33 CFR 325.2(b)(2) and the procedures outlined in the “Letter of Permission for New Mitigation Projects Associated with Approved Compensatory Mitigation Banking and In-Lieu Fee Instruments”, I.D. No. LRL-2010-323.

LOCATION: On forested wetlands and surrounding upland buffers adjacent to the Ohio River, a traditionally navigable water, located within a 52-acre parcel in Campbell County, Kentucky

PURPOSE: To provide aquatic habitat enhancement and establishment and upland buffer enhancement.

DESCRIPTION OF WORK: The St. Anne’s Wetland Restoration Project would enhance approximately 20.7 acres and establish 7.3 acres of forested wetland habitat and enhance approximately 17.8 acres of wetland buffer. The on-site wetlands are adjacent to the Ohio River, a Traditionally Navigable River (TNW). The Corps has determined that the undertaking has “no potential to affect historic properties”; therefore, in accordance 36 CFR 800.3(a)(1), Appendix C, Section (3)(b), USACE Interim Guidance issued by the Corps on 25 April 2005, no consultation with the State Historic Preservation Officer is required and Section 106 of the Historic Preservation Act is complete. The Corps has determination that the project “may affect, not likely to adversely affect” twelve federally-listed taxa. In a letter dated June 27, 2018, the U.S. Fish and Wildlife Service concurred with the Corps’ determination; therefore, obligations under Section 7 of the Endangered Species Act have been fulfilled for this proposal.
