JOINT PUBLIC NOTICE FOR PERMIT APPLICATION SUBMITTED TO U.S. ARMY CORPS OF ENGINEERS AND MONTANA DEPARTMENT OF ENVIRONMENTAL QUALITY SUBJECT: The U.S. Army Corps of Engineers, Omaha District, (Corps) is evaluating a permit application by the Montana Department of Transportation (MDT) to improve the mobility and safety along US 212 and through the town of Roberts. Additionally, improvements to the stormwater collection and drainage systems will be improved to alleviate flooding issues within the town of Roberts. This notice is to inform interested parties of the proposed activity and to solicit comments. This notice may also be viewed at the Corps web site at: http://www.nwo.usace.army.mil/Missions/RegulatoryProgram/Montana/PublicNotices.aspx AUTHORITY: This application is being evaluated under Section 404 of the Clean Water Act for the discharge of dredged or fill material in waters of the United States. APPLICANT: Tommy Griffeth Montana Department of Transportation PO Box 201001 Helena, Montana 59620-1001 LOCATION: The approximately 1.6 mile long project site is located near Rock Creek, within Sections 29, 31, and 32, 15, Township 5 S, Range 21 E, near Latitude 45.36060o, Longitude -10916737°, Roberts, Carbon County, Montana. There is approximately 1,818 linear feet of the tributaries to Rock Creek, and 2.27 acres of emergent non-tidal wetlands within the project area. PROJECT DESCRIPTION: The Roberts project begins at reference post (RP) 81.3 on US 212 and extends north through the town or Roberts to RP 82.9. The proposed project will include roadway shoulder widening, new surface, addition of a two-way left turn lane, intersection realignments, signage, and extensive drainage work. Grading will include both cut and fill sections within the new right-of-way. Drainage work includes construction of a new diversion berm on the west side of the roadway, installation of a new larger Reinforced Concrete Box Culvert crossing, the widening of an existing drainage ditch to increase the capacity to accommodate the stormwater being directed away from the town of Roberts and towards a wetland adjacent to Rock Creek. A berm will be constructed within the wetland to ensure the

increased flows are not redirected back to the town of Roberts. Direct impacts of the proposed project includes approximately 987 linear feet of impacts to four separate jurisdictional waters and conversion of 828 linear feet of another jurisdictional water to manage stormwater. Five additional waterway crossings are currently being evaluated for section 404 jurisdiction. The proposed total area of non-wetland waters is approximately 0.212 acre. The project will directly impact approximately 2.27 acres of emergent non-tidal wetlands at 11 separate wetlands adjacent to Rock Creek. Potential indirect impacts to 6.83 acres of emergent non-tidal wetlands resulting from a berm being placed in wetlands to direct water flows away from the wetland, and the conversion of a waterbody that drains a wetland to manage stormwater. The applicant's preferred alternative would result in permanent impacts to 1,815 linear feet of tributaries to Rock Creek and 2.27 acres of emergent non-tidal wetlands. The applicant's stated project purpose is to improve the mobility and safety along US 212 and through the town of Roberts. Additionally, improvements to the stormwater collection and drainage systems will be improved to alleviate flooding issues within the town of Roberts. The attached drawings provide additional project details. ADDITIONAL INFORMATION: Alternatives. Alternative 1: No action. The no action alternative does not meet the project objectives. Alternative 2: Preferred Alternative. Reconstruction of the roadway along the project corridor so the project objectives would be met. Reconstruction would result in: · Improved pavement conditions; · Improved intersection geometry at key locations; · Improved level of service by providing passing lanes in rural segments, where appropriate, and making intersection improvements; · Wider roadway shoulders in rural segments; · Flatter ditch slopes in rural segments; · Reduction in clear zone encroachments in rural segments; · Increased snow storage with wider and deeper roadside ditches; · Improved driver visibility of approaching wildlife by clearing thick brush and trees within the clear zone; · Reduction in differential speed controls by providing turn lanes, where, needed; and · Improved highway-related stormwater drainage in Red Lodge and Roberts. Alternative 2: Eliminated from Further Study. In addition to the No Action and Preferred Alternative, other options were evaluated and eliminated from further analysis because they failed to meet project objectives, resulting in undesirable impacts, and/or were not supported by the public. These options include: · Construction for additional travel lanes throughout the project corridor. A four-lane divided roadway was considered, but dismissed based on a traffic analysis showing the existing two-lane roadway could provide adequate capacity through the project design year. · Consideration to realign the project corridor. Three portions of the project were considered for roadway alignment shifts in either direction would not minimize wetland

impacts substantially and would result in additional environmental impacts, including relocations. Consideration for speed limit changes throughout the corridor. MDT conducted a speed study of the corridor, which resulted in a recommendation to maintain the existing speed limits. Studies show that motorists have a tendency to drive at speeds they feel comfortable and that simply lowering the speed limit is not likely to lower driving speeds. Consideration of transit management alternative. This alternative was not considered viable due to the rural nature of the area and relatively low traffic volumes. Consideration for narrower shoulder widths outside of Roberts. Typical sections that included 4-foot shoulders of a combination of 4-foot paved shoulders with 4-foot gravel shoulders were evaluated. However, these options were dismissed since the preferred alternative for 8-foot shoulders provides additional safety, improved level of operation, and is desired by the public. Consideration for parking lanes and sidewalks in Roberts. These options were dismissed since there is no identified need for on-street parking in Roberts and sidewalks were previously placed one block east of and parallel to US Highway 212. Consideration for a different typical section in Roberts. A typical section consisting of two 12-foot travel lanes, two 7.5 feet shoulders, two 7-feet sidewalks, and curb and gutter on both sides of the roadway was considered. Following analysis of traffic data, however, it was determined a Two-Way-Left-Turn-Lane was warranted and that there was available right-of-way to accommodate storm drainage using a roadside ditch rather than curb and gutter. Consideration for different realignment options for Cooney Dam Road and East Maple Street intersections in Roberts. Options evaluated included realignment of the East Maple Street, directly opposite Cooney Dame Road, realignment of Cooney Dam Road to a right angle, and realignment of Cooney Dam Road directly opposite East Maple Street. These realignments were dismissed because of impacts to Roberts School and failure to provide substantial reductions in traffic conflicts.

Mitigation: MDT proposes to provide Permittee Responsible Mitigation at the Vince Ames Mitigation Site managed by MDT at a 1:1 ratio for 2.27 acres of permanent wetland impacts. The Vince Ames Site was constructed prior to impacts proposed by his project and is currently in long term management. MDT proposes no mitigation for the permanent impacts to the nonwetland tributaries (irrigation ditches) to Rock Creek. OTHER GOVERNMENTAL AUTHORIZATIONS: The Montana Department of Environmental Quality, 1520 East 6th Avenue, Post Office Box 200901, Helena, Montana 59620-0901 will review the proposed project with the intent to certify in accordance with the provisions of Section 401 of the Clean Water Act. The certification, if issued, will express the State's opinion that the operations undertaken by the applicant will not result in a violation of applicable water quality standards. The Montana Department of Environmental Quality hereby incorporates this public notice as its own public notice and procedures by reference thereto. HISTORIC PROPERTIES: The Federal Highway Administration is lead federal agency for determining compliance with Section 106 of the National Historic Preservation Act for this project and has completed a cultural resource review of the project site in conjunction with their obligations under Section 106 and the National Environmental Policy Act. The Omaha District's initial review, based on currently available information, indicates there are no recorded

properties within the permit area. It has been determined that the project will have no potential to cause effects to properties listed. ENDANGERED SPECIES: The Federal Highway Administration is the federal lead agency for determining compliance with the Endangered Species Act. Based on the information provided, the project would have no effect on Federally-listed endangered or threatened species or their critical habitat. The above determinations are based on information provided by the applicant. EVALUATION FACTORS: The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the described activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit, which reasonably may be expected to accrue from the described activity, must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the described activity will be considered, including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and, in general, the needs and welfare of the people. The activity's impact on the public interest will include application of the Section 404(b)(1) guidelines promulgated by the Administrator, Environmental Protection Agency (40 CFR Part 230). COMMENTS: The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. All public notice comments will be considered public information and will be subject to review by the applicant. The Corps is particularly interested in receiving comments related to the proposal's probable impacts on the affected aquatic environment and the secondary and cumulative effects. Any person may request, in writing and within the comment period specified in this notice, that a public hearing be held for the purpose of gathering additional information. Requests for public hearings must be identified as such and shall state specifically the reasons for holding a public hearing and what additional information would be obtained. The request must be submitted to the U.S. Army Corps of Engineers, Helena Regulatory Office, Suite 2200, 10 West 15th Street, Suite 2200, Helena, Montana 59626-9705. If it is decided that additional information is required and that a public hearing should be held, interested parties will be notified of the date, time and location. Any interested party (particularly officials of any town, city, county, state, or Federal agency; Indian tribe; or local association whose interests may be affected by the work) is invited to submit to this office written facts, arguments, or objections on or before the expiration date listed on the front of this notice.
