The Sacramento District has finalized regional conditions for the 2012 Nationwide Permits (NWPs) for the Central Valley and Sierra Nevada of California, and the States of Nevada and Utah. The final regional conditions for the State of Colorado will be published by the Albuquerque District. The Sacramento District regional conditions for California, Nevada and Utah, include six regional conditions developed among the Sacramento, Los Angeles and San Francisco Districts. The regional conditions take effect March 19, 2012, the effective date of the 2012 NWPs.

CESPK-RD March 16, 2012 On February 21, 2012, the U.S. Army Corps of Engineers (Corps) published the notice in the Federal Register announcing the reissuance of all existing nationwide permits (NWPs), general conditions, and definitions with some modifications. The Corps also issued two new NWPs, three new general conditions, and three new definitions. The NWPs will be effective on March 19, 2012, and will expire on March 18, 2017.

The Sacramento District has finalized regional conditions for the 2012 Nationwide Permits (NWPs) for the Central Valley and Sierra Nevada of California, and the States of Nevada and Utah. The final regional conditions consist of three lists:

(1) Final Sacramento District Nationwide Permit Regional Conditions for California, excluding the Lake Tahoe Basin (Enclosure 1): This list consists of 26 consolidated regional conditions for projects within the Sacramento District boundaries in California, excluding the Lake Tahoe Basin. (2) Final Sacramento District Nationwide Permit Regional Conditions for Nevada and the Lake Tahoe Basin in California (Enclosure 2): This list consists of 24 consolidated regional conditions for projects within Nevada and the Lake Tahoe Basin in California. (3) Final Sacramento District Nationwide Permit Regional Conditions for Utah (Enclosure 3): This list consists of 24 consolidated regional conditions for project within the Utah.

The regional conditions contain the six joint regional conditions developed among the Sacramento, Los Angeles and San Francisco Districts. These joint regional conditions have been incorporated into the Sacramento District final regional conditions, and have been attached to this Public Notice (Enclosure 4). When combined with the terms and conditions of the Nationwide Permits, the final regional conditions were designed to ensure no more than minor impacts occur to waters of the U.S. For the State of Colorado, the final regional conditions will be published by the Albuquerque District. The final Sacramento District regional conditions take effect on March 19, 2012, with the effective date of the NWPs.

Section 401 Water Quality Certifications:

On March 7, 2012, the Sacramento District received Section 401 Water Quality Certifications (WQC) for NWPs 1, 4, 5, 6, 9, 10, 11, 20, 22, 28, 30, 32 and 38 from the State of Nevada Department of Conservation & Natural Resources, Division of Environmental Protection, Bureau of Water Quality Planning (NDEP-BWQP) (Enclosure 5). These certified NWPs require that notification be provided to the NDEP-BWQP through the submittal of a Section 401 application. In addition, the NDEP-BWQP denied, without prejudice, Section 401 WQC for NWPs 2, 3, 7, 12-19, 23, 25, 27, 29, 31, 33, 35-37, 39, 40-46, 51 and 52. For these NWPs, each project must be evaluated individually for a Section 401 WQC, and prospective permittees must submit a signed Section 401 application to the NDEP-BWQP for these NWPs.

The Sacramento District has not received a decision on Section 401 WQCs from other Federal, State or Tribal entity’s at this time. The Sacramento District anticipates that the applicable Federal, State and Tribal entities will complete their WQC process for the NWPs on or before April 20, 2012.
