Interested parties are hereby notified that the U.S. Army Corps of Engineers, Portland District and the Oregon Department of State Lands are considering a proposal to establish a 59.12-acre wetland mitigation bank, known as the Fairview Creek Wetland Mitigation Bank. The proposed bank site is located in Gresham, Multnomah County, Oregon. The City of Gresham, as bank sponsor, proposes to restore wetland functions and services to an area that has been extensively impacted by farming and decades of gravel mining activities in Township 1 North, Range 3 East, Section 33 (latitude 45o 31’ 31” N, Longitude -122o 26’ 57” W. A Prospectus describing the proposed bank has been received from the bank sponsor and is now available for public review.

This wetland mitigation bank is being proposed by the bank sponsor primarily as a means to meet the requirements for compensatory mitigation for projects which may be permitted by the Corps under the authority of Section 404 of the Clean Water Act and by the DSL in implementing the provisions of Oregon’s Removal-Fill Law (ORS 196.800 - 196.990) and according to Rules for Issuance and Enforcement of Removal and Fill Permits (OAR 141-85) and Administrative Rules for Compensatory Wetland Mitigation Banking. The bank sponsor would sell wetland credits to various parties to meet their obligations under the “no net loss of wetlands” policies of these federal and state regulations.

The proposed bank will generate wetland credits by converting most of two abandoned quarry ponds, which are regionally known as the “Fujitsu Ponds,” to a mix of wetland types. On-site materials will be relocated to raise the bottom elevation of the ponds, while simultaneously lowering the fill elevation around the ponds. Fairview Creek will be realigned into a discrete, unimpounded waterway. The proposed project is being designed to increase native fish and wildlife habitat; improve water quality; reduce public safety hazards by decreasing Glisan Street flooding and eliminating unstable, vertical quarry banks; and increase opportunities for environmental education and wildlife viewing.

The proposed service area, which is the area within which the mitigation credits generated by the bank may be used, consists of that portion of the Lower Willamette/Frontal Columbia 5th field Hydrologic Unit 1709001202 watershed located east of the Willamette River. This service area includes the urbanizing areas of Gresham, Fairview, Wood Village, and Troutdale.

Comments received in response to this notice will be provided to the bank sponsor and to the federal, state and local agencies represented on the mitigation bank interagency review team. This team will work with the bank sponsor to create a detailed bank instrument and legal agreement that will specify the ecological goals of the project; plans for grading, planting, monitoring, and maintenance; and the number and schedule of wetland credits to be made available when performance standards have been met.

The prospectus, which outlines the conceptual plan for this bank, is available for inspection at the Corps and the DSL at the addresses given below. It has been posted along with Multnomah County Removal-Fill permit applications on the DSL website: www.statelandsonline.com/. Comments on this proposed mitigation bank may be submitted to either the Corps or the DSL online or to either address below. Comments should be received no later than December 6, 2014.
