Interested parties are hereby notified that an application has been received for a Department of the Army permit for certain work in waters of the United States, as described below and shown on the attached plan.

Location: The project is located in the Umpqua River Estuary at River Mile 10.75, an unnamed tributary, and adjacent wetlands on Bolan Island, Reedsport, Douglas County, Oregon. The site is in Sections 26 & 27 of Township 21 South, Range 12 West. (43.7127/-124.1046)

Waterway: Umpqua River Estuary, unnamed tributary, and adjacent wetlands.

Project Description: Fred Wahl Marine Construction (FWMC) proposes to construct a new boat maintenance facility consisting of a boat slip and wash basin with a concrete runway on both sides to accommodate the haul-out crane hoist. Impacts include:

Below the Mean High High Water (MHHW)--the excavation of approximately 3,538 cubic yards and the discharge of 205 cubic yards of material in an area measuring 9,059 square feet. Sub-tidal impacts--the discharge of approximately 911 cubic yards and the excavation of 1,010 cubic yards of material from an area measuring 14,780 square feet. Intertidal sand/mudflats—the discharge of approximately 151 cubic yards and the excavation of 933 cubic yards of material from an area measuring 3,652 square feet. Intertidal salt marsh impacts—the excavation of 150 cubic yards from an area measuring 516 square feet. Riparian areas at the Highest Measured Tide (HMT)—the discharge of approximately 30 cubic yards and the excavation of 381 cubic yards of material from an area measuring 2,200 square feet. Included in the above impacts: proposed dredging of approximately 5,939 cubic yards.

Construction activities include the following:

Boat Slip Walls: An approximately 44-foot wide by 127-foot long boat slip would be constructed between the new pier and wash basin. The perimeter of the boat slip would be constructed of sheet piles installed using a vibratory hammer mounted to a crane. The slip wall would be tied to an anchor wall placed below ground approximately 35 to 45 feet behind the face of the slip wall. The two walls would be tied together with rods.

Shoreline Bulkhead Walls: Two shoreline bulkhead walls would be constructed along the bank of the Umpqua River Estuary to contain the existing banks during and after the proposed dredging activities. The walls would be constructed of sheet pile installed utilizing a vibratory hammer mounted to a crane. One shoreline bulkhead wall would extend north from the northern wall slip to the boat slip anchor wall and then an additional approximately 32 feet downstream along the bank of the river. The other shoreline bulkhead wall would extend south from the southern slip to the slip anchor wall and then an approximate 29 feet along the bank of the river. Within the sections between the slip walls, the shoreline bulkhead would be supported by an anchor wall that would be constructed approximately 45 feet behind the face of the wall, and perpendicular to the slip walls. The two walls would be tied together by tie rods.

Concrete Runways: Two approximate 11-foot concrete runways would be constructed parallel to the boat slip. The concrete runways would be utilized by the boat hoist and transport boats arriving at the facility for maintenance. They would be supported by plumb and batter pile bents constructed of 24-inch steel pipe piles. A total of 42 bents would be installed consisting of 84 piles to support the runways. Construction of the concrete runways would occur after all piling has been installed for the runways. Concrete work above the wetted channel would be cured using a spray-on curing compound and visqueen sheeting to minimize water quality impacts. The surface elevation of the runways would remain at 12.6 feet from the shoreline end of the runway to the in-shore end of the wash basin. The runways would be minimally sloped to bring the surface elevation down to the existing grade once the runways reach the railroad tracks.

Concrete Wash Basin: An approximate 150-foot long by 96-foot wide wash basin would be constructed at the end of the boat slip. Boats arriving at the site for maintenance would be guided through the slip by a boat hoist operated on the concrete runways. The boat hoist would then be able to lift the vessel and transport it to the wash basin for cleaning prior to maintenance services. The concrete boat basin would be constructed at the same elevation as the concrete runways, approximately 12.6 feet. It would be equipped with hard points spaced at 20 feet on center. The seven hard points would support cribbing for incoming boats during cleaning and allow for maintenance activities within the wash basin.

Wharf and Riprap Removal: The existing wharf and instream riprap would be removed. Working from a barge, the existing sheet pile along the bulkhead would be removed including the bulkhead fill material. Slip Excavation and Dredging: A boat slip would be excavated to a constant depth of elevation approximately 10 feet between the new sheet pile walls. The dredge line would extend from the existing elevation approximately 10-foot contour within the river channel to the off-shore edge of the concrete wash basin. The river bottom would be graded back at a 3H:1V slope to the upstream and downstream side of the slip to match into the existing grade.

Concrete Pier: A concrete pier would be constructed to provide equipment access to boats in preparation for haul out. The concrete pier would be accessible from the upland portion of the facility via a gravel or paved path adjacent to the northern concrete runway. The deck of the pier would consist of a 196-foot by 70-foot concrete deck supported on 24-inch round steel pipe plumb and batter piles located in a grid pattern. A total of 118 piles would be installed to support the concrete pier.

Floating Dock: An 8-foot by 150-foot floating dock would be located to the west (downstream) of the concrete pier and would serve as a walkway to access moored boats. The dock would be constructed of at least 50 percent metal structural grates to allow water and light to pass through. The dock itself would be designed to float on the water surface. A light grated gangway measuring approximately 20 feet long by 3 feet wide would connect the floating dock to the concrete pier.

Catwalk Construction: A catwalk measuring 2 feet 6 inches wide would be constructed from the end of the upstream concrete runway to the existing dolphins to provide worker access. The catwalk would be constructed of prefabricated walkway with a grated base and tube truss railings and supported with five bents comprised of two 24-inch steel round piles.

Mitigation: If a permit is issued, the Corps will determine what is appropriate and practicable compensatory mitigation. The amount of compensatory mitigation required shall be commensurate with the anticipated impacts of the project.

Purpose: To provide maintenance for large fishing vessels on dry land, facilities to increase business for fabricating fishing vessels, and draw active fishing vessels from the Alaskan fleets to Reedsport.

Authority: This permit will be issued or denied under the following:

Section 10, Rivers and Harbors Act 1899 (33 U.S.C. 403), for work in or affecting navigable waters of the United States.

Section 404, Clean Water Act (33 U.S.C. 1344), for discharge of dredged or fill material into waters of the United States. Water Quality Certification: A permit for the described work will not be issued until certification, as required under Section 401 of the Clean Water Act (P.L. 95 217), has been received or is waived from the certifying state. Attached is the state's notice advertising the request for certification.

Section 404(b)(1) Evaluation: The impact of the activity on the public interest will be evaluated in accordance with the Environmental Protection Agency guidelines pursuant to Section 404(b)(1) of the Clean Water Act.

Public Hearing: Any person may request in writing within the comment period specified in this notice that a public hearing be held to consider this application. Requests for public hearings shall state with particularity the reasons for holding a public hearing.

Endangered Species: Preliminary determinations indicate that the described activity may affect an endangered or threatened species or its critical habitat. Consultation under Section 7 of the Endangered Species Act of 1973 (87 Stat. 844) will be initiated. A permit for the proposed activity will not be issued until the consultation process is completed.

Cultural Resources: An initial evaluation of the proposed project area indicates to the best of our knowledge, the described activity is not located on property registered or eligible for registration in the latest published version of the National Register of Historic Places. At this time the Corps is unaware of any cultural resource surveys of the project area.

This notice has been provided to the State Historic Preservation Office (SHPO), interested Native American Indian Tribes, and other interested parties. If you have information pertaining to cultural resources within the permit area, please provide this information to the Corps’ project manager (identified on page 1 of this notice) to assist in a complete evaluation of potential effects.

Evaluation: The decision whether to issue a permit will be based on an evaluation of the probable impact including cumulative impacts of the described activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefit, which reasonably may be expected to accrue from the described activity, must be balanced against its reasonably foreseeable detriments. All factors, which may be relevant to the described activity will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and, in general, the needs and welfare of the people.

The Corps is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity.

Additional Requirements: State law requires that leases, easements, or permits be obtained for certain works or activity in the described waters. These State requirements must be met where applicable, and a Department of the Army permit must be obtained before any work within the applicable Statutory Authority previously indicated may be accomplished. Other local governmental agencies may also have ordinances or requirements, which must be satisfied before the work is accomplished.
