The District Engineer- Sacramento has issued Programmatic General Permit 10 (formerly PGP 40) in the State of Utah for a period of 5 years. The PGP 10 applies to all waters of U.S. that are part of a surface tributary system over which the State Engineer has regulatory authority and has issued a permit under the State Stream Alteration Program. This permit does not apply to activities undertaken on Tribal lands or to waters such as springs, lakes/reservoirs, fens and wetlands to which the Stream Alteration Program does not apply. SUBJECT: The U.S. Army Corps of Engineers, Sacramento District, (Corps) is issuing a Programmatic General Permit (PGP) for minimal impact activities in the State of Utah. A copy of the permit is attached to this public noticeand found at http://www.spk.usace.army.mil/Missions/Regulatory/Permitting/RegionalandProgrammaticGeneralPermits.aspx. This notice is to inform interested parties of the reissuance. Due to the consolidation of General Permit numbers within the district, PGP 40 has been renamed and will now be known as PGP 10. Authorized activities under construction or under contract to begin construction prior to the January 3, 2016 expiration of the previous PGP 40 will have up to 1 year after the expiration date to complete the authorized activity. AUTHORITY: This action was taken under the authorities of Section 10 of the Rivers and Harbors Act (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344). PGP 10 applies to all waters of U.S. that are part of a surface tributary system over which the State Engineer has regulatory authority and has issued a permit under the state stream alteration program. This permit does not apply to activities undertaken on Tribal lands or to waters such as springs, lakes/reservoirs, fens and wetlands to which the stream alteration program does not apply. The decision to issue PGP 10 was based on the evaluation of the potential individual and cumulative impacts of work authorized under the PGP as well as those impacts associated with anticipated future work. Comments in response to past public notices were considered in this evaluation. The District Engineer concluded that the reissuance of the general permit complies with the Environmental Protection Agency’s Section 404(b)(1) guidelines for evaluating discharges of dredged and fill material into waters of the United States, and that reissuance is not contrary to the public interest. The activities authorized under this PGP are similar in nature and result in similar impacts to water quality and the aquatic environment. They will result in only minimal adverse impacts, both individual and cumulatively.
