State - KY: SPONSOR: The Northern Kentucky University, Center for Environmental Restoration Stream and Wetland In-Lieu Fee Program; PROJECT PURPOSE: To provide aquatic habitat re-establishment, establishment, rehabilitation, and preservation.

This notice describes an application submitted for a Department of the Army (DA) Permit, subject to Section 404 of the Clean Water Act. The project is being considered for authorization in accordance with 33 CFR 325.2(b)(2) and the procedures outlined in the “Letter of Permission for New Mitigation Projects Associated with Approved Compensatory Mitigation Banking and In-Lieu Fee Instruments”, I.D. No. LRL-2010-323.

LOCATION:On unnamed ephemeral and intermittent tributaries and on, and along, Gum Branch (a perennial stream), located within a 229-acre parcel in Boone County, Kentucky Latitude: 38.894016 N Longitude: - -84.763998 W 7.5 Minute Quad: Rising Sun 929

PURPOSE:To provide aquatic habitat re-establishment, establishment, rehabilitation, and preservation.

DESCRIPTION OF WORK: The Big Bone Phase III Stream and Wetland Restoration Project would re-establish approximately 5,097 linear feet, rehabilitate approximately 6,877 linear feet, preserve approximately 7,822 linear feet and allow “natural recovery” of approximately 10,077 linear feet of ephemeral, intermittent and perennial streams. The project would also establish approximately 1.5 acres of wetlands and conduct “no action” on approximately 0.1 acre of wetland and 652 linear feet of ephemeral streams. Unnamed ephemeral and intermittent tributaries from the site flow to Landing Creek or Gum Branch, which are perennial streams. Landing Creek is tributary to the Ohio River, a Traditionally Navigable River (TNW). Gum Branch flows to Big Bone Creek, which is tributary to the Ohio River, a TNW. The project would result in an estimated net gain of 15,674 stream Adjusted Mitigation Units (AMUs). No credit is proposed for the wetland work. The entire project parcel would be permanently protected.

The Corps has determined, in consultation with the Kentucky State Historic Preservation Officer (KYSHPO), and pursuant to 36 CFR 800.5 (d)(2), 33 CFR 325, Appendix C (7)(d) and the Interim Guidance issued by the Corps on 25 April 2005 that the project would result in an adverse effect to a property eligible for listing or listed on the National Register of Historic Properties. A Memorandum of Agreement (MOA) was signed on February 22, 2016 by the KYSHPO.
