21-Day Notice ______________________________________________________________________________ Notice of Proposed Adverse Effects to Fox Stone Arch Bridge in Cowley County, Kansas The Kansas City District will comply with the National Historic Preservation Act (NHPA) of 1966 and 36 CFR 800. The purpose of this public notice is to allow the public an opportunity to express their views on resolving adverse effects concerning the proposed modification of Fox Stone Arch Bridge, a 68' x 29' x 12' single-span masonry stone structure constructed in 1910. Through consultation with the State Historic Preservation Officer (SHPO), the Corps has determined the structure is eligible for listing in the National Register of Historic Places under the thematic nomination: Masonry Arch Bridges of Kansas. The proposed bridge modification qualifies for Nationwide Permit (NWP) 14; however, in accordance with NWP general condition 20, the project must comply with the provisions of 33 CFR Part 325, Appendix C and Section 106 of the NHPA. The Corps is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties. Presently, mitigation discussions have not been initiated. All comments to this public notice should be related to the proposed adverse impacts to Fox Stone Arch Bridge. APPLICANT: Cowley County 311 East 9th Avenue Winfield, Kansas 67156 PROJECT LOCATION: 2.6 miles south, 7.2 miles west of Atlanta on 275th Road crossing Grouse Creek in Section 35, Township 30 South, Range 7 East, Cowley County, Kansas (Coordinates -- Latitude: N 37.398192° - Longitude: W 96.631882°) AUTHORITY: Section 404 of the Clean Water Act (33 USC 1344) ACTIVITY: Cowley County is proposing to modify Fox Stone Arch Bridge by installing a concreteblock wall around each abutment. The proposed modification will provide stability to existing abutments and prevent further erosion. The activity is authorized by Nationwide Permit No. 14 (NWP 14) pending consultation under Section 106 of the National Historic Preservation Act 1966 (amended 1992). PUBLIC HEARING: Any person may request, in writing, prior to the expiration date of this public notice, that a public hearing be held to consider this application. Such requests shall state, with particularity, the reasons for holding a public hearing.
